- you have full legal capacity;
- you agree to comply with these Terms;
- you are not prohibited from using proxy services under applicable law.

- evading bans, suspensions, or enforcement mechanisms
- creating, automating, or managing fake users/accounts
- hacking, exploiting, scanning, or vulnerability probing (beyond permitted testing)
- spamming, DDoS, botnet activity, malware distribution
- fraud, deception, or misleading behavior
- activities violating website Terms of Service
- surveillance of individuals without consent
- infringement of intellectual property
- any illegal activity under applicable laws
Violation of this clause may result in immediate suspension without refund.

5. Service Availability
We strive for high availability; however:
- the Service may be interrupted for maintenance, upgrades, or unforeseen issues;
- we are not liable for downtime or service disruption;
- no service level guarantee is provided unless specified via separate contract.

We are not responsible for user activities conducted through the Service.

- your payment fails or is reversed
- your usage may harm our infrastructure, reputation, or third parties
Upon termination:
- your access to the Service will be revoked;
- unused credits or subscription time are not refundable (unless required by law);
- logs and data may be retained as required for compliance and fraud-prevention.
11. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, including:
- fitness for a particular purpose
- uninterrupted service
- data accuracy
- suitability for specific websites
We do not guarantee that our IPs will work with any specific website or platform.
12. Limitation of Liability
To the maximum extent permitted by law:
PrivateProxy is not liable for:
- indirect, consequential, or incidental damages
- data loss
- profit loss
- business interruption
- customer misuse or unauthorized activities
Our total liability is limited to the fees paid by the customer in the last 3 months before the incident.
13. Indemnification
You agree to indemnify and hold harmless PrivateProxy from any claims arising out of:
- misuse of our Services
- violation of these Terms or AUP
- illegal or unauthorized activities
- third-party claims related to your content or actions
14. Governing Law
These Terms are governed by the laws of:
